These terms of service (“Terms”) govern your use of the website at mentisdigital.co.uk and the related properties operated by Mentis Digital Ltd (“Mentis”, “we”, “us”), a company registered in England & Wales with company number 16560281 and registered office at 128 City Road, London, EC1V 2NX, United Kingdom. By using the site, the AI assistant, our forms, our downloadable resources, or our podcast, you accept these Terms. If you do not accept them, do not use the site.
Commercial engagements with Mentis are governed by a separate, signed services agreement with each client. To the extent of any conflict between these Terms and a signed services agreement, the services agreement prevails for that engagement.
1. The site and what it is
The site is an information and lead-generation property. It includes editorial content, case studies, an interactive lead-magnet conversation (see-if-we-fit), an AI assistant (“Mentis Assistant”), gated and ungated resources, and pages relating to The Signal podcast. The content describes our services in general terms and is not a binding offer or contract.
2. Eligibility and acceptable use
You confirm that you are at least 18 years old and have the authority to bind any business on whose behalf you use the site. You agree not to:
- use the site or its services for any unlawful, fraudulent or harmful purpose;
- upload, submit or transmit any content that is unlawful, defamatory, infringes third-party rights, contains malware or attempts to circumvent security;
- scrape, crawl, harvest or systematically extract content except as expressly permitted, or use automated systems beyond ordinary search-engine indexing;
- reverse-engineer, decompile or attempt to derive source code or training data from the site or the Mentis Assistant;
- impersonate any person, misrepresent your affiliation, or use the site to harass, abuse or harm others;
- resell, sublicense or commercially redistribute the content, branding, frameworks or downloadable resources without our written permission.
We may suspend or terminate access to the site, the Mentis Assistant, or any gated resource at any time, with or without notice, where we reasonably suspect a breach of these Terms.
3. Mentis Assistant (AI chat)
The Mentis Assistant is an AI-powered helper provided for general informational and routing purposes. Its responses are generated by a third-party large-language model and may be inaccurate, incomplete or out of date. The Assistant does not provide regulated advice (legal, tax, employment, immigration, financial, HR or otherwise) and is not a substitute for professional advice. You must not rely on the Assistant for material decisions; for anything material, contact us directly.
Do not enter confidential, personal or special-category data into the Assistant. Conversations are forwarded to the model provider for inference; see our privacy policy.
4. Forms, bookings and SMS verification
When you submit a form — including the see-if-we-fit conversation, The Signal “Pitch Yourself” form, the contact / discovery forms, or any resource gate — you confirm that the information you provide is accurate, that you have the authority to provide it, and that you consent to us contacting you about your enquiry. Booking a meeting via Calendly creates a calendar entry; you may reschedule or cancel from the Calendly link in your confirmation email.
The see-if-we-fit conversation uses Twilio Verify to send a one-time SMS code to confirm your mobile number. Standard carrier message rates may apply on your side. We use the code only for verification and do not send marketing SMS without separate consent.
5. The Signal podcast
The Signal is produced by Mentis. If you submit a guest pitch through this site you grant us a non-exclusive, royalty-free licence to evaluate the pitch internally. Any participation as a guest is subject to a separate written guest agreement covering recording, editing, publication, use of likeness and licensing of the recording across podcast platforms, social media and our website. Nothing said by a guest on The Signal is the official position of Mentis or of any client mentioned.
6. Resources and downloads
Guides, briefs, frameworks and other downloadable resources made available on the site are provided for the personal-business use of the named recipient and their organisation. You may not republish, white-label, resell or use them to train automated systems without our prior written consent. Where a resource is gated by a password supplied to a specific client or partner, sharing the password outside that organisation is a breach of these Terms.
7. Intellectual property
The site, its content (text, layout, code, branding, the Mentis logo and lockup, photography and illustrations), the Signal podcast brand, our frameworks (including the three-layer signal/judgement/execution model), our methodology, and the configuration of the Mentis Assistant are owned by or licensed to Mentis and protected by UK and international intellectual-property law. Except as expressly permitted in these Terms or under applicable fair-dealing exceptions, you have no right to copy, modify, distribute, or create derivative works from any of it.
We welcome inbound links to the site. Framing, hot-linking or aggregation that misrepresents Mentis or causes brand or commercial harm is prohibited.
8. Third-party content and links
The site includes embedded content and links to third-party services (Calendly, LinkedIn, podcast players, analytics, etc.). We do not control those services and are not responsible for their content, availability, or terms. Use of a third-party service is governed by that service’s own terms and privacy notice.
9. Disclaimers
The site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Mentis disclaims all warranties, conditions and representations of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site or the Mentis Assistant will be uninterrupted, error-free, secure, or that any defect will be corrected. Case-study figures describe historical outcomes for specific engagements and are not predictions of future results.
10. Limitation of liability
Nothing in these Terms limits any liability that cannot lawfully be limited — in particular, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under section 2(3) of the Consumer Protection Act 1987. Subject to that:
- to the maximum extent permitted by law, Mentis is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, anticipated savings, business opportunity, goodwill or data, in each case howsoever arising; and
- our total aggregate liability arising out of or in connection with your use of the site, the Mentis Assistant, our forms or any free resource is limited to one hundred pounds sterling (£100). Liability under signed services agreements is governed by the cap and exclusions set out in that agreement.
11. Indemnity
You agree to indemnify and hold Mentis (and its directors, officers and agents) harmless from and against any claim, liability, loss, damage and reasonable cost (including legal fees) arising out of your breach of these Terms or your misuse of the site, the Mentis Assistant, or any resource obtained through the site.
12. Privacy and data protection
Your use of the site is also governed by our privacy policy, which forms part of these Terms.
13. Changes to these Terms or the site
We may update these Terms or change, suspend or discontinue any part of the site at any time. The current version is indicated at the top of this page. Continued use of the site after a change takes effect constitutes acceptance of the updated Terms; if you do not accept them, stop using the site.
14. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute, save that we may bring proceedings to enforce these Terms in any competent jurisdiction where you operate.
